1 AREA OF APPLICATION
The general terms and conditions of sale (hereinafter referred to as "GTC") shall apply to all legal transactions concluded in the online shop www.petit-detail.com (hereinafter referred to as "online shop"). The online shop is managed by the company S Préchoux Carnaille Distribution.
S Préchoux Carnaille Distribution reserves the right to modify these GTC at any time. The version of the GTC valid at the time of the order is decisive and cannot be changed unilaterally for this order. Any conditions of the customer that contradict or deviate from these GTC shall not be recognised.
The offer of products and services in the online shop (hereinafter referred to as "offer") is valid as long as the product can be found in the online shop using the search function and/or as long as stocks last.
For all orders of products requiring a minimum age of 18 years (in particular alcohol and tobacco), the customer confirms by his order that he complies with these legal provisions.
S Préchoux Carnaille Distribution reserves the right to refuse orders exceeding the usual quantities for a household.
2 INFORMATION
2.1 Product and price
Product images in advertisements, the online shop, etc. are for illustrative purposes and are not binding.
The product information in the online shop is provided in the most customer-friendly manner possible, but is not binding on S Préchoux Carnaille Distribution. The manufacturer's data (e.g. manufacturer's warranty) are decisive, insofar as they are valid in Switzerland.
All sales prices published in the online shop are final prices. S Préchoux Carnaille Distribution reserves the right to change the prices of the products and services offered at any time. The price indicated in the online shop at the time of the order is decisive for the conclusion of the contract.
2.2 Availability and delivery time
S Préchoux Carnaille Distribution attaches great importance to displaying the most up-to-date and accurate availability and delivery times in the online shop. Due to production or delivery problems, however, delivery delays may occur. For this reason, all information on availability and delivery times are indicative and may be changed at any time.
3 CONCLUSION OF THE CONTRACT
The products and prices published in the online shop shall be considered as offers. However, these offers are always subject to the resolutive condition of an impossibility of delivery or an incorrect price indication.
For products and services of S Préchoux Carnaille Distribution, the contract is concluded with S Préchoux Carnaille Distribution as soon as the customer places an order in the online shop (hereinafter referred to as "contract").
The receipt of the order is confirmed to the customer by means of an automatically generated order confirmation by e-mail. The receipt of the automatically generated order confirmation does not contain any confirmation that the product can actually be delivered. It only informs the customer that the online shop has received the order and that the contract has therefore been concluded with S Préchoux Carnaille Distribution, provided that the order can be delivered and that the price indicated is correct.
4 DELIVERY TIME
When the order is acknowledged, a provisional delivery date is indicated to the customer.
5 LIABILITY AND EXCLUSION OF LIABILITY
Liability is governed by the provisions of the law. However, S Préchoux Carnaille Distribution shall never be liable for (i) slight negligence, (ii) direct, indirect and consequential damages, loss of profit, (iii) unrealized savings, as well as (iv) damages resulting from a delay in delivery, and (v) any actions or omissions of auxiliaries of S Préchoux Carnaille Distribution, whether within or outside of the scope of a contract.
Furthermore, S Préchoux Carnaille Distribution is not liable for any damage resulting from any of the following causes:
- improper storage, positioning or use of the product, contrary to the contract or unlawful;
- use of incompatible accessories or spare parts (e.g. power supply);
- lack of maintenance and/or improper modification or repair of the product by the customer or a third party;
- in case of force majeure, in particular damage caused by the elements, humidity, falls, blows, etc., which cannot be attributed to S Préchoux Carnaille Distribution and the authorities.
6 PAYMENTS
S Préchoux Carnaille Distribution sends the payment requests for products and services purchased from the online shop directly to the customer.
Payments must be made in euros or Swiss francs.
The customer can use the payment methods offered in the online shop.
The applicable fees are listed under "Payment methods" and are detailed in the order process.
In the case of payment by credit card or other instant payment methods, the payment is debited at the time of ordering.
7 MODIFICATION OR CANCELLATION OF THE ORDER
Orders oblige the customer to accept the products and services. S Préchoux Carnaille Distribution may, at its sole discretion, accept subsequent modifications or cancellations of orders and charge compensation of 20% of the amount of the cancelled order, but at least 2,00€, as well as the possible loss of value (since the order) of the cancelled products.
8 RETURN OF GOODS DELIVERED WITHOUT DEFECT
Under the conditions listed under "Return Policy", S Préchoux Carnaille Distribution grants the right to return its products within a maximum of 30 calendar days.
9 OTHER PROVISIONS
9.1 Data protection
The "Data Protection Declaration" is an integral part of these GTC. By accepting these GTC, the customer also accepts the data protection declaration.
9.2 Partial invalidity
Should individual provisions of these GTC be invalid or unenforceable, the validity of the remaining provisions of the contract shall not be affected.
9.3 Place of jurisdiction and applicable law
All legal relations between S Préchoux Carnaille Distribution and the customer are subject to Swiss substantive law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
For all disputes arising from sales contracts with S Préchoux Carnaille Distribution as contracting party:
For legal actions brought by consumers, the place of jurisdiction is Zurich or the customer's domicile. In all other cases, the exclusive place of jurisdiction shall be Zurich.
9.4 Copyright statement
All rights, in particular intellectual property rights, of the petit-detail.com website are reserved by S Préchoux Carnaille Distribution.
Any reproduction, distribution or other use is prohibited and is only permitted with the express written consent of S Préchoux Carnaille Distribution.
